GENERAL TERMS AND CONDITIONS

These terms and conditions govern the use of this site, makeloo.com (the “Site”). This Site is owned by Laine Québec inc., which operates it under the name Makeloo Studio. By using this Site, you confirm that you have read and understood these terms of service and agree to comply with them at all times.

ACCOUNTS

When you create an account on our Site, you agree:

  • that you are solely responsible for your account and for the security and confidentiality of your account, including any passwords or sensitive information attached to it; and

  • that all personal information you provide to us through your account is current, accurate and truthful, and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you use our Site illegally or violate the acceptable use terms.

SALE OF GOODS

These terms govern the sale of goods available on our Site.

The following goods are available on our Site:

  • Wool, fibres and yarns

  • Knitting and crochet accessories

  • Knitted pieces

The goods covered by these terms are the goods displayed on our Site at the time you access it. This includes all products listed as out of stock. All information, descriptions and images we provide about our goods are described and presented as accurately as possible. However, we are not legally bound by this information, these descriptions or images, as we cannot guarantee the accuracy of every product we supply. You agree to purchase these goods at your own risk.

We reserve the right to modify, reject or cancel your order when necessary. If we cancel your order and have already processed your payment, we will issue a refund equal to the amount paid. You agree that it is your responsibility to monitor your payment method to confirm receipt of any refund.

PAYMENTS

Accepted payment methods are described at the end of this document.

When you provide us with your payment information, you confirm that you have authorized the use of, and access to, the payment instrument you have chosen. By providing your payment details, you confirm that you authorize us to charge the amount due to that payment method.

If we believe your payment has violated any law or any of our terms of service, we reserve the right to cancel your transaction.

SHIPPING AND DELIVERY

See our shipping policy for details. Orders delivered outside Canada may be subject to customs duties and taxes.

You are responsible for paying these duties and taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for paying these duties or taxes, nor for any failure on your part to pay them.

You must provide us with a complete and accurate delivery address, including the recipient’s name. We are not responsible for delivering your goods to the wrong address or the wrong person as a result of inaccurate or incomplete information.

CONSUMER PROTECTION ACT

Where Quebec’s Consumer Protection Act, or any other consumer protection legislation in your jurisdiction, applies and cannot be excluded, these terms and conditions do not limit your legal rights and remedies under that legislation. These terms and conditions shall be read subject to the mandatory provisions of that legislation. In the event of a conflict between these terms and conditions and that legislation, the mandatory provisions of the legislation will apply.

LIMITATION OF LIABILITY

Makeloo Studio and its staff will not be held liable for any actions, claims, losses, liabilities and expenses, including legal fees, arising from your use of the Site.

INDEMNITY

Except where prohibited by law, by using this Site you hereby indemnify and hold harmless Laine Québec inc. (Makeloo Studio) and its staff from any action, claim, loss, damage, liability and expense, including legal fees, arising from your use of our Site or your breach of these terms and conditions.

APPLICABLE LAW

These terms are governed by the applicable laws of the Province of Quebec.

SEVERABILITY

If at any time any provision of these terms is found to be inconsistent or invalid under applicable law, that provision will be deemed void and removed from these terms. All other provisions will remain unaffected, and the rest of these terms will still be considered valid.

CHANGES

These terms and conditions may be amended from time to time to maintain compliance with the law and to reflect any changes in the way we operate our Site and the way we expect users to behave on our Site. We recommend that users check these terms and conditions from time to time to stay informed of any updates. Where necessary, we will notify users of changes by email or post a notice on our Site.

You can pay by credit card (we accept Visa, Mastercard and American Express); payments are processed by Stripe, one of the most recognized names in online payments, with rigorous, end-to-end security.

We also accept PayPal: you can use your credit card or your PayPal balance to complete your purchase.

We are a Canadian site and all transactions are charged in Canadian dollars. If you are buying from outside Canada, your credit card company will convert the amount into your currency at the current international exchange rate, plus any fees charged by your card issuer.
